This agreement is not assignable by the customer without the prior written consent of seller.

  • In no event shall Express Cash Registers & POS Solutions be liable for any Loss or Profit or any other commercial damage,including but not limited to Special, incidental,Consequential or other damages due to hardware and/or Software provided.
  • We will try our best to keep the Product information & imagesare kept up to date wherever possible. But Images displayed may vary from actual products & information provided can be changed without prior Notice.
  • We do not have provide any insurance for the products delivered.Insurance for any goods sent or sent after repairorforthereturns to us is the responsibility of the customer.
  • Proper Shipping/Freight charges are to be chosen from the table provide under Freight.If proper Shipping/freightCharges are not selected , we may have tocontact you & advise.This may result in some delay in delivering the goods .
  • All prices shown under the products are inclusive of GST and are subject to change without any notice to customers.
  • Any products listed on web site with $0.00 value means that item is not available for sale or is discontinued

PAYMENTS

We accept the following payment methods:

  • Cash at Showroom Counter or By Visa & Master Cardor By Cheques or By Direct deposit & payment by Phone (Name on the card& Security code Required)

SHIPPING POLICY

  • We only ship to Australia & the shipping fee indicated on our site is for Australia only.
  • You are requested to select the correct Shipping chargesbased on your delivery address & the Rateof shipment when placing an order.
  • We don’t ship to P.O. BOX .Shipping address must be a residential or business address.
  • Orders normally process and ship within 1-7 business days of placing you order. We will notify you if it will take longerto ship your order.
  • Orders returned as “undeliverable” or “refused” will be charged a minimum $25 fee.
  • Please double check all shipping address information to avoid delays.
  • Any order related damage claims must be called within 24 hours of receiving your package. You must keep all package contents (i.e. shipping carton, packing material, promotional items, and product) as intact as possible.

In addition, the method of shipment you choose does not necessarily mean you will receive your order within the specified number of days. Please note that we count from the day we ship and not from the day you place your order. However, we guarantee that we attend to our customers on a first come first serve basis. Please take note that we do not ship on Saturdays, Sundays and Holidays. You may receive two or more shipments if the items come from different distribution points.

Warranty:

  • All products sold (Except Consumables & software) through this website comes with 12 months Return to Base Warranty (At Preston showroom located at 565 High Street ,Preston Victoria 3072 Australia) unless otherwise stated.
  • All warranty claims must be provided with written proof of purchase along with detailed description of the problem .This information could be provided to us via email atsolutions@expresspos.com.au or By phone at (03)9471 4666 or 1300 650 466
  • Under no circumstances the goods (under warranty or out of warranty)should be sent backto us without notifying us as they will not be accepted & will be returned back at customer’s expenses.
  • Warranty is given for all the hardware supplied in Australia only. Goods returnedas part of a warranty claim shall be forwarded byto its supplier or to the manufacturer for assessment and either rejection of the warranty claim or repair or replacement in accordance with the applicable manufacturer’s warranty.
  • All goods sent under warranty claims must have the original packaging without any writing on them and customer must ensure that those goods or boxes are in re-salable condition.
  • If a warranty item is found NOT to be faulty a service fee of $75 (Inc GST) may be charged and further $ 75 (Inc GST) per hour for the time to inspect and test these goods.
  • All warranty goods are Return to Base to Express Cash Registers & POS Solutions office at 565 High Street Preston 3072 in Melbourne, Victoria, Australia or otherwise agreed in writing.The customer is responsible for sending to /or Pickup (Under warranty )From Express Cash Registers & POS Solutions office with the prepaid Freight charges as per mutual agreement.
    Attending warranty jobs at site (only available in Melbourne) will attract a Call out Fee.Please Contact us at (03)9471 4666 for more details.

Return/Refund & Cancel Policy:

The Customer agrees

  • Not to cancel the whole or part of any order placed with Express Cash Registers & POS Solutions (www.expresspos.com.au)
  • Not to return goods without Express Cash Registers & POS Solutions prior written approvaland then only.
  • if goods are in new and re-salable condition with undamaged packaging and less than 7 days have passed since delivery;

Return of Consumables & Supplies

  • We do not accept returns on all types of media & supply such as Labels, Thermal Labels, Papers, Cash Register Paper Rolls, Thermal or Bond Paper, Ink Rollers, Ink Ribbons and etc.

Hardware Return policy

All authorized returns must be clean, without scratches and resealed in a factory condition, 100% unregistered, complete, and contain all original manufacturer boxes with the original packing materials, all manuals, cables, accessories, blank warranty cards, accessories, all promotional items that were included with the shipment, and any other documentation included with the original shipment. No credit for returns shipped improperly or missing manufacturer warranty cards and/or promotional items, etc. Credit will not be given since unit/s cannot be sold as new when these items are missing.

Software Return Policy

We do not offer refunds on software where the License Number or Activation Code has already been issued and sent to the customer. Unlike physical goods, electronically distributed software and software licenses can be easily duplicated. Once a license has been issued, it is unfortunately not possible for us to recall all copies. Therefore, Software is Non-Refundable, Non-Returnable and cannot be Exchanged.

Refund policy For Professional Services (Programming ,Setting & designing Fee ):

All services, including Programming,Setting, Keyboard Design, and Label Printing etc are non-refundable.

Dead On arrival Policy

If a product arrives Dead On Arrival, Please contact us immediately by Phone or Via E-mail.Once acknowledged ,the productsmust be returned with all original packaging and accessories for the return to be accepted. Full refunds are only given to non-functional products. Customer is responsible for shipping costs on returned items.

  • Express Cash Registers & POS Solutions may elect to take back goods on such terms as
  • Express Cash Registers & POS Solutions requires including:

(i) Original invoice as proof of purchase is produced

(ii) Not to return any goods which were custom made, custom ordered or custom acquired.

Note: All products must be returned with no markings or writing on the original box. If a product shows signs that the entire product and packaging was removed from its original box, a refund may be denied resulting in shipment of the product back to the customer.

Restocking Fees

If the returned item meets all the above requirements, it will be accepted and a restocking fee maybe applied depending on the sale valueof the returned items:

  • 20% of purchase price (minimum $15) if a product(s) of equal or greater value is purchased as a replacement.
  • 25% of purchase price (minimum $35) if no replacement is purchased.
  • You will be charged for the cost of new parts to replace for the worn or damaged parts in addition to the 25% restocking fee.

Shipment Refusal Fees

Purchaser’s refusal to accept shipment of goods from shipping carrier for any reason will result in a refund of the merchandise’s current market price, less a restocking charge of 15% or $25 whichever is greater. Original freight paid by customer will not be refunded in some cases; customer will be responsible for the cost of the return trip.

Refund of Shipping & Handling Charges:

  • Shipping & Handling fees for all returns are not refundable. In addition, customer is responsible for shipping costs on returned items.

Money back Guarantees & price Protection

Express Cash Registers & POS solutions does not offer money-back guarantee on any product. Please note Express Cash Registers & POS solutions doesn’t offer price protection on our already reducedprices. Due to nature of our business Price you pay as ontoday may change tomorrow. 5) Payment is to be made in advance prior to delivery of the goods unless credit has been provided in

writing to the customer. If credit is provided, payment in full shall be made within 7/14/30 days of the date of

statement. For the purposes of this clause, ‘payment’ means cleared funds. Express Cash Registers & POS Solutions

reserves the right to change the mode of payments. Some cards require 3D secure authentication which is similar to

chip and pin for online transactions.Unless your correct pin is entered, the transaction may decline. At the time

of payment you will be required to present details of a valid card. These details will be passedat our

system to processes payment. The option is available for payment to be taken via telephone, fax or post.Please

call for details. No details of cards will be kept on record by us provided to us by phone.; We will immediately destroy any details given

to us over the phone once payment has been processed.For repeat orders, we will keep details securely with your

permission.We will send you an email to remind you of the placement of a repeat order and of the need to pay if

you do not wish us to process repeat payments. If payment is not received in 7 days of your order or receiving your

order we reserve the right to add an additional 10% each week to your order as a penalty for late payment and extra

6) It is the responsibility of the client to ensure that delivery instructions are clear and concise. Once delivered

adverse weather, traffic jams or supplier failure, may prevent this from happening. We will attempt to call

customers on contact numbers held by us, to minimize your inconvenience but we cannot accept any liability for any

inconvenience caused. We reserve the right to change our delivery days.

8)The Customer agrees that all contracts made with Express Cash Registers & POS Solutions shall be governed

by the law applicable in the State nominated by Express Cash Registers & POS Solutions and the Customer agrees to

submit to the jurisdiction of the appropriate Court nominated by Express Cash Registers & POS Solutions in the

capital city of that State. If no State is nominated than Victoria shall be deemed to be nominated.

9) All Prices are subject to withdrawal or variation at any time prior to acceptance of order. Express Cash

Registers & POS Solutions also reserves the right to amend prices at any time for the undelivered portion of any

order. Provided, however, that the Customer shall have the right to cancel such outstanding balance of an order

within seven days from the date of notification of an amendment in the price thereof.

10) Express Cash Registers & POS Solutions has the right to take possession and dispose of goods as it sees fit at any time until full

payment has been received. The Customer grants permission to Express Cash Registers & POS Solutions to enter any property where

any products are stored with such force as is necessary.Immediately upon delivery the Customer accepts liability for the safe custody of

goods and agrees to indemnifyExpress Cash Registers & POS Solutions for any losses relating thereto.

11).The Customer agrees to limit any claim on Express Cash Registers & POS Solutions

* to the cost of replacement of goods or the supply of equivalent goods and/or services again.

* Any claim, loss or expense arising which is made after 7 days from the date of delivery of goods and/or services (or at all once goods have been unpacked, on-sold or otherwise used or applied) after which there shall be deemed to be unqualified acceptance;

* Any contingent, consequential, direct or indirect, special or punitive damages arising in any way and whether due toExpress Cash

Registers & POS Solutions negligence or otherwise.
* any claim relating to any alleged fault or defect in any way caused or contributed to by the customer, Express Cash Registers &

POS Solutions and/or any third party.

b). Express Cash Registers & POS Solutions shall not be liable in any way for
(i). Any defect or damage caused in whole or in part by misuse, abuse, neglect, electrical or other

overload,improper installation, repair, alteration or accident;
(ii) technical advice or assistance given or rendered by it to the Customer whether or not in

connection with the manufacture or supply of good for or to the Customer.

c) No other term, condition, agreement, warranty, representation or understanding whatsoever, express or

implied or otherwise binding upon Express Cash Registers & POS Solutions other than by these Terms & Conditions is made or given.

12)The Customer agrees

a) if any dispute arises concerning any order (and including any question of identity or authority or any

telephone, facsimile or computer generated order) the internal records of Express Cash Registers & POS Solutions

shall be conclusive evidence of what was ordered in all respects;

b) each order the Customer places shall be and be deemed to be a representation by it made at that time

that it is solvent and able to pay all of its debts as and when they fall due;

c) failure to pay Express Cash Registers & POS Solutions in accordance with these Terms shall be and be

deemed conclusive evidence that the Customer had no reasonable grounds for making the representation referred toand that

representations were unconscionable, misleading and deceptive;

d) when any order is placed the Customer shall inform Express Cash Registers & POS Solutions of any facts

which would or might reasonably affect the commercial decision by Express Cash Registers & POS Solutions to accept

the order and any failure to do so by or on behalf of the Customer shall create and be deemed to create an

inequality of bargaining position, shall be and be deemed to be the taking of unfair advantage of Express Cash

Registers & POS Solutions and to be unconscionable, misleading and deceptive.

13) EXCLUSIONS
a). If Express Cash Registers & POS Solutions publishes material concerning its goods, its services and/or its prices anything so published which is incompatible with these Terms is expressly excluded.
b) The Customer shall rely on its own knowledge and expertise in selecting any goods and/or services for

any purpose and any advice or assistance given for or on behalf of Express Cash Registers & POS Solutions shall be

accepted at the Customer’s risk and shall not be or be deemed to be given as expert or adviser nor to have been

relied upon by the Customer or anyone claiming through the Customer.
c) Subject to the relevant provisions of the Trade Practices Act , all goods are sold subject to any

manufacturer’s trading terms, warranties and representations applicable to those goods.

d) Subject to the relevant provisions of the Trade Practices Act , Express Cash Registers & POS Solutions

shall not be liable nor responsible for any failure of goods or services to comply with any requirements of the

Customer or any other person (whether relating to manufacture, design, installation and/or any intended use or

otherwise).

e) Subject to the relevant provisions of the Trade Practices Act , Express Cash Registers & POS Solutions

disclaims any responsibility or liability relating to any goods and/or services

(i) made or performed to designs, drawings, specifications and/or procedures etc. and/or with

materials which are provided and/or approved (whether fully or in part) by or on behalf of the Customer;

(ii) utilised, stored, handled and/or maintained incorrectly or inappropriately.

(f) The Customer agrees to check all goods for compliance with all relevant applicable standards and

regulatory bodies [“Standards”] before use, on-sale or application and/or to use or apply all goods in according

with those Standards with all manufacturer and/or Express Cash Registers & POS Solutions recommendations and/or

directions and in accordance with good commercial practice.

14) Breach or Default

a) Upon any default or breach of these Terms or of any dealings withExpress Cash Registers & POS

Solutions by the Customer,Express Cash Registers & POS Solutions may call-up all monies, retain all monies paid

and/or cease further deliveries and/or provision of services and recover from the Customer all lost profits and/or

at its discretion take immediate possession of any goods without prejudice to any other rights and without being

liable in any way to any party.

b) The Customer agrees not to commence or continue or permit to be commenced or continued through it any

suit or action against Express Cash Registers & POS Solutions while the Customer is in such breach or default.

c) The Customer agrees to indemnify Express Cash Registers & POS Solutions for all costs and expenses

incurred by Express Cash Registers & POS Solutions and its solicitors including indemnity costs, mercantile agents

and other parties acting on Express Cash Registers & POS Solutions behalf in respect of anything instituted or

being considered against the Customer whether for debt, possession of any goods or otherwise.

d) Express Cash Registers & POS Solutions may apply any payment in reduction of recovery costs and/

expenses, interest and/or part or all of any principal debt in such order of priority as Express Cash Registers &

POS Solutions in its absolute and unfettered discretion elects.

e) The Customer irrevocably authorizes the payment directly to Express Cash Registers & POS Solutions of

any debt due to the Customer by any debtor of the Customer in reduction of any amount due by the Customer to

Express Cash Registers & POS Solutions under these Terms or otherwise.

5) If Express Cash Registers & POS Solutions elects not to exercise any rights arising as a result of any

default or breach of these Terms or of any dealings with Express Cash Registers & POS Solutions this shall not

constitute a waiver of any rights of Express Cash Registers & POS Solutions relation to any subsequent or other

breach.

16)a). In the absence of proper acceptance of a quote, all sales are made by Express Cash Registers & POS

Solutions as its ruling price at the time of delivery.

b) Government imposts (including any GST or equivalent) will be to the Customer’s account.

c)Express Cash Registers & POS Solutions price lists shall be deemed to exclude government imposts unless Express Cash Registers & POS Solutions otherwise indicates.

17) Express Cash Registers & POS Solutions shall not be in default or in breach of any contract with the

Customer as a result ofanything beyond the reasonable control of Express Cash Registers & POS Solutions and

includes any strike or lock-out.

18). a). If the Customer commits or is involved in any act of insolvency the Customer shall be deemed to be in

default under these Terms & Conditions.

b) An act of insolvency is deemed to include bankruptcy, liquidation, receivership, administration or the

like.

19 Any part of these Terms shall be capable of severance without affecting the other part of these Terms.

20) Variation or cancellation of these Terms or any order must be approved in writing.

21) To the best of your ability, you must warrant that any information you provide is true, accurate, complete and

confidential. By using the site, you license us to use or alter any information provided by you.
